The TSA is all over the news - and rightfully so. But what to Canadians know about OUR air travel system. For me - nothing really. Just personal experience at Pearson International Airport.

The TSA is all over the news – and rightfully so. But what to Canadians know about OUR air travel system. For me – nothing really. Just personal experience at Pearson International Airport. I’ve never had a problem there but I have also never traveled with my children, so rather than be ignorant of the law I thought I would find out.

First, I did the obvious: searched online. To my surprise I wasn’t able to come up with anything after almost an hour of digging. I think my search terms were the problem but there is a chance that the information just isn’t out there yet because I am only looking for answers to 3 questions:

1. Is it illegal to record video within the airport?
2. What Constitutional/Charter rights do I forfeit when I/we enter the building?
3. What recourses do I have to protect my rights and the rights of children in my care?

I failed to find anything with regards to these terms so I switched to a legal-minded search and looked for laws surrounding these things. I found no laws with regard to video recording in the airport and for our Rights I found the obvious: the Charter and Constitution. Two documents well worth reading and memorizing. I am still working on the latter.

I thought about it for a bit and while I was wandering through my mind I found myself roll-playing possibilities at the airport. What WOULD I say if security told me to shut off the camera? What WOULD I say if they selected me or my kids of a physical pat-down? This lead me to thinking that it would be good to call the police and ask. I found that the Peel Regional Police department is responsible (at least in part) for law enforcement (LE) at Pearson and they liaise between other Canadian LE bodies. So I called them.

Peel Regional Police

The Peel Regional Police Constable I spoke with did a great job of handling my questions when he clearly thought I was paranoid. Here are the condensed points from my phone calls:

He said that if the child sets off the metal detector the security staff will Wand the child and, where the wand beeps, will pat the child. No matter how much I explained that I was against this he maintained that it is procedure, nothing to worry about, non-invasive and would be fine. I think it is rather obvious that if this is done against the child’s will it is therefore a violation of the child’s rights. This is when he called me paranoid and told me to stay off YouTube and Facebook because “those people” are the bad ones who have done something wrong but are omitting it from the video. I countered that I saw video of agents touching children and he said he sees that all the time where people put drugs into the diapers of children etc. To me that is not justification for the blanket violation of our rights. If drugs are a big issue the solution is to place dogs at the screening lines. Not more convenient and not cheaper but damn sure not a violation of our rights.

The bottom line with this constable was simple: You do not have to do this, but then you cannot fly. There is no law that says you must give up your rights and there is no law that can make you but because the airport is privately owned and operated they can make up rules that – if you do not follow – can restrict you from using their planes. That statement is clear and I understand it, however it is not within the legal confines of our Constitution or Charter. Why not? Well, what power, right or authority does a private organization have that allows it to supersede the rule of law? NOT having that kind of power is one of the defining principles behind the Rule of Law vs the Rule of Men.

The Canadian Air Transport Security Authority

Alright, onto the next phone call. The constable suggested that I call the Canadian Air Transport Security Authority (CATSA) because they are the government body that conducts the screening process at the airport. He gave me their website address and from there I found the phone number and called. The first person I spoke to was not sure how to handle my questions about our Rights so he transferred me to another department, but before he did that he said that there should be no problem with video. He put me on hold, did some fact-checking and came back and said

As far as I can tell -I’ve just verified and there’s nothing from the security aspect of the secured checkpoints that would prevent you from using a camcorder AT ALL.

When I spoke to the second person at the CATSA I explained my question again. I pointed out that we have the right to unreasonable search and seizure and that I understand bags must be searched prior to boarding. I also pointed out that wasn’t an issue. The issue is that I refuse to allow anyone under any circumstances to put their hands on my children. Period. His response was,

Uhm, ok, no you have the right… Uhm, I’m, I’m not authorized to uh uh to- not to comment on that but I don’t know the answer uh uh to that question. What I am gonna do is gonna take your name and number down, and I am gonna get someone to give you a call regarding this because thats… uh ??eached the security operations centre and like I said I don’t have any uh answer to give you, but I will find someone that has uh uh that’s available to comment and give you more information on top of that.

There was no way I was going to give him anything. Last year I called the Ontario Health Care office to ask questions about travel and they froze my health card and I was still inside Canada. It has been dramatic to resolve and it is still not resolved. So no, you cannot know who I am.

I politely inquired about alternative ways of reaching that persons whom has the answer but his only solution was to use their website to make email contact because it would enable a paper trail. They really want to know who the people are who contact them.

Pearson Airport

Using the number given to me by CATSA I called Pearson. The person who answered was surprised by my questions and seemed to really want to get off the phone with me. I didn’t allow it by continuing to ask my questions is different ways. I was put on hold while he asked if anyone knew what to tell me about my right not to be touched. When he came back he said that he has no idea how to answer that because the Charter is universal and does not apply to people selectively, so I should ask a lawyer about things like this. I was tired of this person so I did not push the video issue and I allowed the call to come to an end.

Air Canada

Because I am willing to miss my flight in order to enforce and protect the rights of myself and my children I called Air Canada to ask, “If I have a problem along the way – like a hiccup at the security checkpoint – and I miss my flight can I catch the next one?” The answer was very simply yes. It is called a same-day change and it is $75, which I believe is per ticket.

The Final Word

Well, there isn’t one. I did not find a law that blocks me from recording but I did not hire a lawyer to ensure that there really is not one. It is a possibility that there is a law but it is more likely there would be case-law regarding it. I am not worried about the video issue because I would only want to record our interactions with airport security so that I would have some sort of unbiased evidence in the unlikely event of an incident. We know that the word of the agent it going to supersede mine and we know that airport video will not be available if it is in my favour. Refer to the guy the cop tasered/taser’d/tased to death in B.C.. Actually, refer to YouTube like the Peel constable suggested I stay away from. It’s all over the place – if you don’t have video to support you then you’re guilty.

As for our right to unreasonable search and seizure… Well it was made clear to me that we are in fact allowed to tell them not to touch us, however they can then refuse to allow you past security. In other words – not fly. This illegal. This is in place because there are people who smuggle and they want to catch them. I do not mind my bag going through an x-ray machine to ensure that I am safe because if there were no bag searches people would smuggle a lot more often and I do not want to be trapped inside a 700km/hr death-tube for hours on-end with a smuggler or anyone else who operates outside of the law. I would not consent to a bag search for entrance into a building or bus, but a plane is not a problem.

I realize that I am giving up my right to free against unreasonable search my private property to fly but there is no way I will give up my children’s rights to their privacy. Search their bags but do not touch their bodies. And yes, I am willing to miss a flight to enforce and protect their rights.

Now if we could only get Justin Bieber to wear this message in front of a camera.

Alex Jones, nationally syndicated talk radio host, documentary film-maker has started another campaign to get the people of the USA to act called “V for Victory Resistance Campaign.”

I like the idea of this campaign because it is trying to cause everyone to act in the Right during a time when people are so content to do nothing when government is acting in the Wrong. The problem I have with the posters is that when you remove the URL to infowars.com the message does not stand on it’s own. You need to visit infowars to get the rest of the information that supports the story.

I am a fan of infowars and I think people should be reading the news that’s posted there, however, if the campaign really wants to cause people to act it should be planting seeds into every viewer of the poster, regardless of the websites they visit. You should be showing the V sign because you want Victory, Freedom and everything it represents – not because someone told you to.

That’s why I took some time this afternoon to remix the posters. They look very much the same as what Infowars has created. I changed the text, removed the website address and added a circle to the background, to pay homage to “V is for Vendetta.”

The page has a link to a URL that wasn’t working at the time and I really wanted to take a look. Since I could not see it as intended I tried to recreate it by downloading the images from the fb page instead. In the process I decided to go ahead and customize it. When I was done I thought others might want to use it as an alternative and so I filmed the instructions on how I customized my fb profile.

Schools require a signed informed consent letter before administering anything related to your child's health.

Everyone has the right to refuse. Don't be fooled.

In a recent blog post by National Post writer Tamsin McMahon, is rather one-sided which is completely unjournalistic. There was no attempt to cover why the boy refused the vaccine, no coverage of the ample data illustrating vaccines are unsafe and in the end helps paint a picture that refusing to accept what the school is imposing will escalate to a problematic situation.

After reading this the message I see is that if you are not compliant you are a problem. That boy had every right to refuse the vaccine – regardless of any pro or con argument on vaccine efficacy. That boy was wrong to make a threat, but what are the details of the incident that resulted in the boy resorting to threatening? Was he the type of kid with a history of negative outbursts, or was he so pressured, scared or otherwise under duress to the point that he felt he had no other option?

Hepititis-B is transmitted via needle sharing and sex. What are the odds of a 12 year old picking up this virus? Sure, it’s possible, but the probability is so low that the province has no place administering vaccines for it, specially considering the amount of data that clearly illustrates vaccines are in fact harmful.

A good journalist would address these aspects of the story.

by Barbara Loe Fisher

There are three basic facts you should remember when you are exercising your right to make an informed, voluntary vaccination choice for yourself or your child in America:

Informed Consent is a Human Right: The right to voluntary, informed consent to a medical intervention, including use of a pharmaceutical product such as a vaccine that can injure or kill you or your child, is a human right.

While the State may have the legal authority to mandate use of vaccines, nobody has the moral authority to FORCE you to get vaccinated or vaccinate your child without your voluntary, informed consent

Vaccine Laws Have Exemptions: In 1905, the U.S. Supreme Court affirmed the legal authority of state governments to pass laws requiring citizens residing in the state to use certain vaccines.

Today, all 50 states have enacted vaccine laws that require proof of vaccination for children to attend daycare, elementary, junior and high school and college.

Vaccine requirements vary from state to state and all 50 states allow a medical exemption to vaccination; 48 states allow a religious exemption to vaccination; and 18 states allow a personal, philosophical or conscientious belief exemption to vaccination.

To find out what your state vaccine law says and which exemptions you may take and how to take them, click here.

Freedom is Not Free, Become a Vaccine Choice Advocate: Many state governments now require nearly three dozen doses of more than a dozen vaccines to attend school. Medical and religious exemptions are becoming harder to get and exemptions for reasons of conscience are under attack by proponents of forced vaccination.

The National Vaccine Information Center is working with citizens in states to expand or protect legal exemptions to vaccination.

Six Principles for Protecting Vaccine Choices

First Principle: It’s Your CHOICE

When exercising your right to voluntary, informed consent to vaccination for yourself or your child, remember that state vaccine laws contain:

Legal requirements that school and health officials are responsible for enforcing

Legal exemptions that you have the legal right to choose to exercise. (Public schools must allow vaccine exemptions outlined in state vaccine laws, but private religious or other non-state operated schools may reject vaccine exemptions.)

Most state vaccine laws do not allow unvaccinated students with vaccine exemptions to attend school during confirmed outbreaks of certain infectious diseases for defined periods of time.

Remember: Nobody has the moral authority to force you or your child to be injected with a vaccine without your voluntary, informed consent and you have the legal right to exercise exemptions to vaccination according to the laws in your state.

Second Principle: You Have the Right to KNOW

You have the legal right to know the risks and complications of vaccines BEFORE you make the choice of whether or not to allow your child to be vaccinated.

The National Childhood Vaccine Injury Act, passed by Congress and signed into law by President Reagan in 1986, directed all doctors and other vaccine providers to give parents written information about vaccines BEFORE children are vaccinated.

Remember: All vaccines and other pharmaceutical products carry a risk of injury or death and those risks can be greater for some than others.

Never agree to use a vaccine, drug or other product without fully informing yourself about ALL risks.

The product information insert, which drug companies by law must include with every vial of vaccine provided to public health clinics and private doctors’ offices, includes a description of the vaccine’s reported reactions and precautions.

You can ask for a copy of that vaccine information insert from your doctor or state health department.

Third Principle: Be INFORMED and Prepared

Knowledge is power. Arm yourself with accurate information about vaccination and health. Do your own research and talk to one or more trusted health care professionals before you make any health care decision.

Become an educated consumer and you will be empowered to defend your right to freely make voluntary choices about health, including vaccination, for yourself and your children.

Remember: If you arm yourself with accurate information about vaccines and health, you will be prepared to intelligently and rationally discuss your vaccine choices with your family, friends, colleagues, doctors, elected officials and others in your community.

Fourth Principle: Take RESPONSIBILITY for Your Words and Actions

When you are standing up for your right to know, and freedom to choose, whether or not to vaccinate yourself or your child, how you go about exercising your rights will determine whether or not you will succeed.

In your contact with doctors, school or government health officials, remain calm but politely firm when explaining and defending the vaccine choice you have made.

If you are treated with disrespect or are harassed in any way by a doctor or government official, do not engage in an unproductive argument. You may want to contact an attorney, your elected state representatives or local media if you or your child are threatened.

To publicly post a report of harassment for your vaccine choice, click here.

Remember: Treat others as you want to be treated, even if you are being attacked or harassed for the vaccine choice you have made.

Protect yourself and your family by seeking legal or other expert counsel, if necessary.

Serve as an example for others in your community whenever you defend your right to exercise voluntary, informed consent to vaccination, including the right to decline to use one or more vaccines for yourself or your child.

Fifth Principle: Keep WRITTEN Records

Be sure to ask your doctor for copies of your medical records or your child’s medical records, including recorded information about vaccinations and illnesses. Under the National Childhood Vaccine Injury Act of 1986, doctors and other vaccine providers are required by federal law to:

Write down any serious health problems that occur after vaccination in a child’s permanent medical record

Keep a permanent record of all vaccines given, including the manufacturer’s name and lot number

Report serious health problems, hospitalizations injuries and deaths that occur after vaccination to the federal Vaccine Adverse Events Reporting System (VAERS). (If your doctor won’t report, you have the right to make a vaccine reaction report to VAERS).

Remember: It is wise to keep written records of your interactions with doctors, school and health officials that involve vaccine choices you make, as well as copies of any vaccine exemptions you file with the state. You may have to hire an attorney to defend your informed consent rights when it comes to vaccination and it is important to have written records.

Sixth Principle: Be COURAGEOUS

It is not easy to stand up for the right to make informed, voluntary choices about vaccination when public health officials, the pharmaceutical industry and many medical doctors are putting pressure on all Americans, especially parents, to use every government recommended vaccine.

The fact that the numbers of doses of government mandated vaccines have tripled in the past quarter century, while the numbers of chronically ill and disabled children have also tripled, offers an opportunity to have a long overdue public conversation about the effects of vaccination on individual and public health.

Remember: Freedom of thought and exercise of free speech is protected under the U.S. Constitution.

You have the right to talk privately and publicly about any concerns you have about vaccine necessity, safety and effectiveness, and to work with your elected officials to modify the vaccine laws in your state.

Become an engaged, courageous citizen activist and protect your right to make vaccine choices.

Vaccination and U.S. Law: A Brief Summary

Medical Exemptions: All 50 states allow medical exemption to vaccination.

Medical exemptions to vaccination must be written by a medical doctor (M.D.) or doctor of osteopathy (D.O.) and are usually reviewed annually by school or state health officials.

Since 1986, the Centers for Disease Control (CDC) and American Academy of Pediatrics (AAP) have eliminated most officially recognized medical reasons for withholding vaccination (contraindications) so that almost no medical condition qualifies for a medical exemption to vaccination.

In most states, school or state public health officials can question or even deny a medical exemption to vaccination written by a doctor if it does not strictly conform to CDC and AAP contraindication guidelines.

The National Vaccine Information Center is working with citizens who want to change vaccine laws to prevent state school or health officials from questioning or denying a medical exemption to vaccination written by a doctor.

Religious Exemptions: All but two states (West Virginia and Mississippi) allow religious exemption to vaccination.

These exemptions are worded differently in different states and require different forms of written documentation that must be submitted to state governments supporting a sincerely held religious belief opposing vaccination.

Some states require a notarized affidavit or letter from a spiritual advisor attesting to the sincerity of a person’s religious beliefs about vaccination. The religious exemption is under attack and, in some states like New York, parents are being grilled about the sincerity of their religious beliefs by state officials and denied religious exemptions to vaccination so their partially or completely unvaccinated children cannot attend public schools.

The National Vaccine Information Center is working with citizens, who want to protect their rights to religious exemptions, to add or re-write the religious exemption in state vaccine laws.

Conscientious Belief Exemptions: 18 states allow conscientious, personal or philosophical belief exemption to vaccination. These states come the closest to protecting a citizen’s right to exercise voluntary, informed consent to vaccination in America. They are:

Arizona, California, Colorado, Idaho, Louisiana, Maine, Michigan, Minnesota, New Mexico, North Dakota, Ohio, Oklahoma, Rhode Island, Texas, Utah, Vermont, Washington and Wisconsin

This exemption, like the religious exemption, is under attack by forced vaccination proponents who want to eliminate non-medical exemptions to vaccination in America.

The National Vaccine Information Center is working with citizens who want to protect or add conscientious belief exemption in state vaccine laws.

Vaccine Exemptions for Military Personnel: All branches of the U.S. Armed Services provide medical and religious exemptions to vaccination, but those exemptions must be first declared before enlistment in the military.

If a military recruit does not clearly state a medical or religious objection to vaccination BEFORE joining the military, he or she gives up the right to object to vaccination during active military service. Failure to obey an order to vaccinate while on active military duty can result in demotion, imprisonment and involuntary discharge from the military, including dishonorable discharge.

After enlistment, legal assistance is often required to successfully object to vaccination without being subjected to sanctions.

Family dependents of active military personnel often must obtain approval from military officials to exempt children from vaccination for medical reasons or religious objections, especially if the children are attending military-operated daycare or schools or are deployed to foreign countries or re-entering the U.S. after living in a foreign country.

Vaccine Exemptions for International Travel: Different countries have different laws requiring vaccines to enter or leave the country.

Most developed countries, including those in Europe, currently do not require visitors to show proof of vaccination. However, some countries in Africa, Asia and elsewhere may require certain vaccines to enter or exit. Click here to check the CDC website on travel vaccine requirements.

Other Vaccine Exemption Issues: Vaccine choices also can affect adoption, immigration, child custody arrangements during divorce proceedings, eligibility for health insurance and government entitlement programs, and medical care.

Children adopted from foreign countries as well as in the U.S. may be required by US law and adoption agencies to receive certain government mandated vaccines.

Immigration laws also contain vaccine requirement provisions.

In cases of divorce, one parent may attempt to gain full custody of a minor child by using the vaccine choice issue as leverage.

Some families have been dropped from medical insurance plans or barred from eligibility for government funded medical care and food supplement programs if children are not given all government recommended vaccines.

Increasingly, pediatricians are refusing to treat children who are not fully vaccinated and, in some instances, medical personnel in hospital emergency rooms and physicians’ offices have reported parents to state child social services agencies for child medical neglect for refusing to vaccinate their children. In these circumstances, you may need to consult to protect informed consent rights.

Legal Options

The National Childhood Vaccine Injury Act of 1986 was passed by Congress to protect vaccine manufacturers and vaccine providers from liability for vaccine injuries and deaths in civil court.

If a child is injured by a government recommended or mandated vaccine, the child must sue the Secretary of Health for damages under the Act in the U.S. Court of Claims in Washington, D.C.

If the vaccine injured child is turned down for federal compensation or offered too little to provide for the child’s lifetime care, a lawsuit may be filed in civil court against a vaccine manufacturer or negligent doctor with certain restrictions.

By 2009, about $2 billion had been awarded to vaccine victims for brain inflammation and immune system damage leading to permanent injury or death, even though two out of three children are turned away for federal compensation.

The Bottom Line

When you or your child is injured by a vaccine, the risks are 100 percent, and you will be left to deal with the consequences. Those who make and give vaccines are protected from liability in civil court, and federal vaccine injury compensation is very difficult to get.

There is no guarantee that a vaccine will, in fact, protect against an infectious disease or that exposure to an infectious disease will cause a complication, injury or death. Good health is about so much more than vaccination and preventing experience with infectious disease.

Vaccines are pharmaceutical products that carry a risk of injury or death that is greater for some than others. The right to informed consent to medical risk-taking is a human right. Empowering ourselves with information and taking responsible action to protect the right to exercise voluntary, informed consent to vaccination in America is one of the most important actions we can take as citizens to protect our freedom.

Don’t let anyone force you or your child to take a vaccine without your voluntary, informed consent.

If a doctor denies you or your child medical care because you want to make vaccine choices, find another doctor.

If a doctor threatens you, or if a government official denies a medical or religious exemption that you have legally filed, find an attorney to help you.

If you don’t like the vaccine laws in your state, contact your elected officials and work to change them.

Together, we can educate the public and reform vaccine laws in America to protect the right to make informed, voluntary vaccination decisions for ourselves and our children.

Google's founding mantra of "Don't Be Evil" no longer applies

So I ran into two videos where the CEO of Google, Eric Schmidt, talks about the policies at Google. It is obvious after watching these that Google’s founding mantra of “Don’t Be Evil” no longer applies. Google is now bending to the will of every government dictator by censoring in China and by spying on us in North America. The facts remain, no matter what your opinion is, that google tracks, traces, stores and shares your data and as you hear their CEO say, it’s under the unconstitutional patriot act.

So keep in mind that while you or your kids are online searching around for whatever you find interesting, it could lead to an investigation that removes your rights as a human being… Under the loving Patriot Act. Up here in Canada, you’re free of the Patriot Act until you want to cross that border, but don’t be fooled for a second to think that the RCMP or CSIS will be blindly ignoring you or the Americans spy groups.

I have a friend who is doing some school work in the medical field and as a result they’re being told to vaccinate themselves and provide documentation to the school. The school wants to see the complete up to date child-hood immunization record + the seasonal flu vaccination + the H1N1 vaccination. Anyone who does not show this documentation is told that they will not be allowed to continue their education.

When I heard that I naturally said “Bull sh¡t!” It is probably fresh in everyone’s mind that the United States medical workers are being forced to take the vaccinations, and if they refuse they’re told to sign a waiver which unknowingly doubles as their resignation, or they’re straight-up fired. This is not my opinion, this is documented fact – look it up. In fact, let that be a blanket statement throughout this article – look up whatever you want because everything I am putting in here has a source (whether it be internet, newspaper, television, radio or actual phone calls I personally made. Try that one sometime.)

The Public Health Agency of Canada states in their Canadian National Report on Immunization, 1996, the following:

“Immunization is not mandatory in Canada; it cannot be made mandatory because of the Canadian Constitution. Only three provinces have legislation or regulations under their health-protection acts to require proof of immunization for school entrance.”

and

“It must be emphasized that, in these three provinces, exceptions are permitted for medical or religious grounds and reasons of conscience; legislation and regulations must not be interpreted to imply compulsory immunization.”

So with that in mind I acquired a copy of the Constitution Act of 1982. It guarantees, in Part 1, the following:

“Guarantee of Rights and Freedoms
1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.
Fundamental Freedoms
2. Everyone has the following fundamental freedoms:
(a) freedom of conscience and religion;
(b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;
(c) freedom of peaceful assembly; and
(d) freedom of association.”

You can clearly see that the constitution does indeed back up the preceding statement regarding the inability to force a vaccination/drug onto any person within the borders of Canada. And should anyone feel that the constitution is being ignored they can then refer to this item:

“24. (1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been in- fringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.”

So as it stands right now I have contacted the school with this information and I await their response. I have used email because that is a legal communication, and that means I will likely not get a reply. When I have more to add, I will.

Keep in mind that a violation of ONE person’s rights if a violation of EVERYone’s rights.

Hi there

I am writing about the Medical Program at School Name in Town. I have what I feel is an important question regarding my personal health and safety and as such I wish to remain anonymous for the time being. I hope that request does not interfere with the addressing of my concerns.

I have been informed that students are required to produce immunization records that are up to date as well as required to take the seasonal flu vaccine as well as the H1N1 vaccine, and students who do not comply with this will not be able to continue their studies. My concern is that I will not vaccinate myself and I will not exit the school willingly.

I have done some preliminary research into this and I am at a point where I feel it is time to contact the school directly with my concern. What I am looking for with this letter is:

i.) Guidance
a.) If I have reached the wrong person/department for this matter, please direct me to the correct person/department.

ii.) Solution(s)
a.) If I have reached the right person/department then I can, and will, provide my current immunization records, but if those records are not up to date I will not update them any further, and I respectfully request the legal document that dictates I must do so.
b.) If I have reached the right person/department and the above requested legal document is available then there is another document, which I do not know it’s official name, that I would also respectfully request be sent to me. For lack of a proper term I am referring to this document as the Statement of Conscious or Religious Belief Affidavit, as it compares to the Immunization of School Pupils Act, 1990.

Research and Documentation that stands behind my point of view include the following:
a.) The Public Health Agency of Canada
b.) The Canadian Constitution.
c.) The Canadian Charter of Rights and Freedoms.
d.) The Health Care Consent Act.
e.) The Quarantine Act.

The Public Health Agency of Canada states in their Canadian National Report on Immunization, 1996, the following:

“Immunization is not mandatory in Canada; it cannot be made mandatory because of the Canadian Constitution. Only three provinces have legislation or regulations under their health-protection acts to require proof of immunization for school entrance.”

and,
“It must be emphasized that, in these three provinces, exceptions are permitted for medical or religious grounds and reasons of conscience; legislation and regulations must not be interpreted to imply compulsory immunization.”

So with that in mind I acquired a copy of the Constitution Act of 1982. It guarantees, in Part 1, the following:

Guarantee of Rights and Freedoms
(a) freedom of conscience and religion;
(b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;
(c) freedom of peaceful assembly; and
(d) freedom of association.

It clearly states that every Canadian is guaranteed the freedom and right to peaceably think and do as they wish. The Constitution also states the following, with regard to the infringement or refusal of freedoms, and rights:

24. (1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been in- fringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.

Recently certain media outlets have reported on the Health Care Consent Act, 1996, specifically making reference to the Emergency Treatment without Consent: capable and incapable persons. This act states:

Emergency treatment without consent: incapable person
(2) Despite section 10, a treatment may be administered without consent to a person who is incapable with respect to the
(a) there is an emergency; and
(b) the delay required to obtain a consent or refusal on the person’s behalf will prolong the suffering that the person is apparently experiencing or will put the person at risk of sustaining serious bodily harm. 1996, c. 2, Sched. A, s. 25 (2).

Emergency treatment without consent: capable person
(3) Despite section 10, a treatment may be administered without consent to a person who is apparently capable with respect to the treatment, if, in the opinion of the health practitioner proposing the treatment,
(a) there is an emergency;
(b) the communication required in order for the person to give or refuse consent to the treatment cannot take place because of a language barrier or because the person has a disability that prevents the communication from taking place;
(c) steps that are reasonable in the circumstances have been taken to find a practical means of enabling the communication to take place, but no such means has been found;
(d) the delay required to find a practical means of enabling the communication to take place will prolong the suffering that the person is apparently experiencing or will put the person at risk of sustaining serious bodily harm; and
(e) there is no reason to believe that the person does not want the treatment. 1996, c. 2, Sched. A, s. 25 (3).

This act does not provide a circumstance whereby School Name can, within the scope of the Canadian Constitution, the Canadian Charter of Rights and Freedoms, the Health Care Consent Act, justify the forcible immunization of a Conscious, Capable person who is not suffering, is not at risk of sustaining bodily harm, does not want the treatment and can clearly communicate with the faculty and health care personnel.

The Quarantine Act of Canada, 2005, dictates that the Minister of Health must make several designations (medical practitioners, quarantine operators, quarantine locations etc) before a conveyance or traveller can be detained and/or treated. The interpretation of the terminology within the act clearly define conveyance and traveler to mean entry/exit across Canadian borders. The reason I mention this act is even this act does not give the unjust powers of forced inoculation.

I now come back to my original purpose: I am looking for direction to the correct person/department to properly handle my concerns OR a legal document that dictates that I must vaccinate myself or be barred access to the school, along with a secondary document that I can submit as my conscious and legal exemption from the vaccination(s) and maintain my good standing student status.

Thank you for reading and taking the time to address my concerns.
Sincerely,
Anonymous Student.
